Legal pluralism and intercultural interpretation in the Ecuadorian and Bolivian constitutional case-law

This paper investigates Ecuadorian and Bolivian constitutional jurisprudence from the perspective of legal pluralism and intercultural interpretations. Building on theoretical arguments of weak and strong legal pluralism, it seeks to account for the legal monism characteristic of the normativist posture of Ecuador’s Constitutional Court. On the other hand, it offers an explanation of the postmodern legal pluralism associated with Bolivia’s Plurinational Constitutional Court based on the intercultural and decolonial interpretation of law.
