Abstract

The purpose of the current article is to outline the analytical categories in order to implementa general balance of the discussion on Communitarian Justice, subject that has been approached from multiple angles. lt is about recognizing the tapie in its complexity, interpretations, meanings, senses and normative referents, besides observing its relations with explanatory contexts, social practices, social actors, government public institutions or policies in their different scales referring. As starting hypothesis we considered that the speech of communitarian justice oscillates between the paradigms of social regulation and social emancipation: the first is assumed as an instrument of domination directed to the reestablishment of orders in situation of deterioration, erosion of institutionalism, and illegality and the second that emphasizes its relation with freedom projects, autonomy, in dependence and dignity, in times of recognition of the diversity, the difference and the distinction as supports of democracy, pluralism and the fairness.
