La petición de tutela como pretensión procesal una aproximación estructural

The structural elements common among the tutela -claim raised by any person before the judge, and in front of any public authority or qualified private individuals in order to protect the fundamental rights- presenta true connection of agreement with the structural definition of procedural pretension. This is understood as a claim raised by an active character before a judge, and in front of a passive character for an specífic good of life.
Furthermore, on being a motion looking for the declaration of certainty of a situation -the infringement or plus the right- plus the imposition of a benefit -order tending to the threat or the infringement to cease-, I consider that the tutela may be classified any difficulty as a declarative pretension of sentence.
