Follow-up to the Implementation of the Standards of Integral Repair in The Class Action of Doña Juana Landfill

Abstract

The class action presented due to the collapse of the Doña Juana landfill ended with a ruling by the State Council in which integral repair standards were applied in 2012, which merit monitoring and analysis. This investigation inquired about whether restorative justice measures applied to the landfill have been effective for the affected population; Therefore, a descriptive matrix was constructed that accounts for the status of the rights’ guarantee, with the following findings: regarding the assessed damages, the judicial sentence was not paid in a timely manner, which was linked to a perception of confusion by those affected; and violations of family privacy, recreation and use of free time, healthy environment and public health and, indirectly, civil and political rights continue.
