Abstract

The function of exercising jurisdiction is maybe the most sublime part in the right. To say the right in a certain conflicting situation is not a simplistic exercise and that it can be developed without any consideration of the social necessities that it is exposed in an explicit context. The judge is the subject called to find a space where the right and the justice can reconcile or to reconcile. From this character depends that the right is a balance instrument, of justice or that it finishes being only norm product of the necessities of a minuscule group that holds the power. This writing seeks to present an optimistic vision of the right where the paper of the jurisdiction goes beyond the single legality.
