The appliance of the principle of proportionality in the administrative sanctions of the Public Service Law

Abstract

This article analyzes the provision's domiciliary service in an efficient and timely way, it's the maximum expression of the social's state law,  the function's  republic president to perform control, inspection and vigilance to the companys through the Superintendency of Residential Public Services (article 370, Constitution Political,1991) which is empowered to impose sanctions on those who violate the rules that regulate the topic (article 81 ,  Law 142, 1998) as intervention of the state in the economy. Finally will make a study of the scope of applying the principle's proportionality in the administrative sanctions of the law of domiciliary public services, seen as a limit of the punitive power of the State and as a mechanism to making arbitrary decisions.
