Extra-contractual liability of the Bolivian state in the LaMia case, a brief legal analysis

Abstract

The present work deals with extra-contractual liability taking a real case as an object of analysis, a case that does not want to be reviewed by the Bolivian Government, from the perspective of responsibility, since it acquired a fault charge on an aircraft accident of a aircraft that should’ve never taken off from a Bolivian airport and that, with the provoked fateful event, three countries, Bolivia, Colombia and Brazil as the main affected, since the passengers who died in the accidents are of said nationalities, the work is concluded by pointing to our opinion to the guilty party of this harmful event. Concepts of liability, non-contractual and objective liability, fault, serious fault, intent is reviewed.
