The homosexuality like obstacle for the permanency in the armed forces. Approaches to a legal jurisprudential line of the constitutional court, between 1992 and 2007

Abstract

This article is the result of the study of the book "The Right of the Judges" of Doctor Diego Eduardo lopez Medina, from which the elaboration of a legalline around the right ofthe Free Development ofthe Personality, in relation to the homosexuality in the Colombian Armed Forces arises as a proposal. Between the periods 1992- 2007 the Jurisprudence is ar.alyzed. This work sets out a proposal, and it is that the elaboration of a Jurisprudential line cannot be, in front of the eyes of outsiders in its elaboration, an entire achievement, but instead, its process must be displayed step by step, in such a way that, whoever gets immersed in it, knows which its origin was, even from the same moment at which the idea arose to create it. Perhaps then, this will be the first step in arder to implement legallines to beco me part of the legal custom, and thus, the rights of the judges really assume its true value in law practice.
