caso Metrocable del Picacho

Abstract

In the Municipality of Medellín, a series of urban transformations aimed at the construction of a new city model that aims to be inclusive and equitable are being presented, the problem is that these actions are being implemented improperly, since, in the construction process of these public works is not taking into account the effects on the inhabitants, leaving as a consequence the violation of collective and individual rights.

In the Medellín Development Plan 2012-2015, the construction of a new metrocable line was planned in the northwestern sector of the city of Medellín, in charge of the Empresa de Transporte Masivo del Valle de Aburrá, mainly impacting the 12 de Octubre neighborhoods and La Paralela, located in commune 5. As a result of the project's implementation, a massive displacement of the inhabitants of the aforementioned sectors was generated, especially in La Paralela neighborhood.

The Legal Clinic of Public Interest -UNAULA- intervened in that case by advancing relevant Constitutional Actions such as Rights of petition and a Popular Action with request for precautionary measure, in order to achieve the least negative impact on the affected population, through fair compensation and prior, in addition to a resettlement according to law.

Although the claims were denied, this experience left a great apprenticeship that aims to be constantly retaken in future cases and, in addition, the objectives of social intervention stipulated in the statutes of the Legal Clinic were met.
