This article describes the most important subdivisions of criminal abolitionism, through the contributions of authors such as Vicencio Guagliardo, Louk Hulsman, Bernat de Celis and Nils Christie. It also underline the main causes of the declaration unconstitutional state of affairs of the Colombian prison and penitentiary system, which have been established and compiled by the Constitutional Court through its power of review faced with judicial decisions in the field of tutelage action. Which in turn have been imposed by prisoners from different cities of the country. Equally, the present document constitutes a reflexive criticism based on the main structural deficiencys of the Colombian seclusion system in relation to abolitionist postulates, which seeks to make the reader aware of the causes that have made it impossible to overcome such declaration.
